CAT sets aside Girish Kumar's posting as DG

Hyderabad, Jan 28: In a significant pronouncement that would have far-reaching implications on future appointments, Central Administrative Tribunal (CAT) on Thursday set aside the appointment of senior IPS officer Girish Kumar as Andhra Pradesh’s  Director General of Police. The judgment came in the wake of a petition filed by former DGP SSP Yadav challenging the appointment of Girish Kumar as the DGP.The CAT directed the State Government to commence the selection process afresh and appoint a new DGP within two weeks.

The CAT has  passed strictures against the government and observed that the selection procedure was based on irrelevant considerations, non-application of mind and arbitrary.Further, the CAT urged the Government to allow Girish Kuamr to continue as DGP until a new DGP was appointed.CAT stated in its pronouncement that the Government has the right to transfer former DGPs Mohanty and Yadav to any post in any capacity. Finally, the CAT ordered the Government to pay the difference in pay for both Mohanty and Yadav who suffered due to their change in the office.
