The last minute petition filed by 1993 Mumbai blasts convict Yakub Memon in Supreme Court to escape from hanging punishment scheduled for implementation in a Nagpur jail at 7 AM on Thursday that is tomorrow is rejected by the apex court. This would clear all the decks for Yakub Memon execution. He is key man behind the plan of deadly Mumbai blasts which killed nearly 260 civilians. According to an update, Yakub Memon’s mercy petition is also rejected by Maharashtra Governor Vidyasagar Rao.
Yakub’s lawyers argued on Government agencies did not follow the correct procedure in this case as Yakub was informed merely 17 days before his hanging date is a violation of Fundamental Right. So, they asked the Court to stop the hanging judgment given by a TADA court. However, three judge bench Supreme Court observed no procedural lapse in the case after upholding the validity of curative petition procedure.
Court also said that it is not inclined to discuss on the issue of second mercy plea made by Yakub to the Maharashtra Governor. Now, the power of mercy petition which can stop Yakub Memon’s death sentence tomorrow lies only in the hands of President Pranab Mukherjee although he rejected the first plea last year.
